Information on the algorithm for business entities obtaining permits for the purchase, transportation, destruction and storage of explosive materials

Pursuant to Clause 9 of the Regulation on the Permit System, approved by Resolution of the CMU dated 12.10.1992 No. 576, on acquisition, storage and transportation of explosive materials must have appropriate permits.

The procedure for issuing relevant permits is determined by the Instruction on the procedure for the manufacture, acquisition, storage, accounting, transportation and use of firearms, pneumatic, cold and cooled weapons, devices of domestic production for firing cartridges, equipped with rubber or metal projectiles similar in their properties of non-lethal action, and cartridges for them, as well as ammunition for weapons, main parts of weapons and explosive materials, approved by order of the Ministry of Internal Affairs dated 21.08.1998 No. 622 (hereinafter - Instructions).

To date, in order to obtain permits from the National Police of Ukraine for the purchase, transportation and storage of explosive materials, the subject of economic activity together with the petition to the bodies (units) of the National Police provides:

I. For the purchase of explosives (validity period up to 6 months)

  1. Certificate of the State Labor Service of Ukraine (hereinafter - State Labor) for the purchase of explosive materials;
  2. Permit for blasting, issued by the State Labor Office. To obtain it, the enterprise should send an application to the territorial body of State Labor in accordance with Appendix 4 Procedure for issuing permits for the performance of high-risk works and for the operation (use) of machines, mechanisms, and equipment of high risk, approved by the Resolution of the Cabinet of Ministers of Ukraine dated 26.10.2011 No. 1107, or a declaration on conducting this type of economic activity. To receive a declaration, you need to submit an application (through the Diya portal) to the territorial division of State Labor regarding carrying out business activities under KVED 39.00 “Other waste management activities. Demining works and similar works, for example, detonation of explosives)”.
  3. An act on the suitability of the premises where explosive materials will be stored or a signed agreement on the lease of existing warehouses for storing explosive materials. The assessment of the premises in terms of compliance with the requirements established by NPAOP 0.00-7.08-07 is carried out by a commission consisting of representatives of the NPU, the State Emergency Service, State Labor and interested organization;
  4. Payment order (receipt) for the service. The administrative fee is 270 hryvnias.

II. For the storage of explosives (validity period up to 3 years)

  1. Certificate of State Labor authorities for the operation of a storage place for explosive materials;
  2. Passport of the owner of the storage of explosive materials in accordance with Appendix 34 Instructions and the act of acceptance of the place of storage of explosive materials into operation (in the absence of a passport a scheme of the warehouse and a plan of the surrounding area in a radius that corresponds to the safe distance calculated by the air shock wave from the largest storage facility of munitions are attached, and for a mobile warehouse, the area served by the warehouse is indicated);
  3. An act on the suitability of the premises where explosive materials will be stored or a signed agreement on the lease of existing warehouses for storing explosive materials. The assessment of the premises in terms of compliance with the requirements established by NPAOP 0.00-7.08-07 is carried out by a commission consisting of representatives of the NPU, the State Emergency Service, the State Labor Service and interested organization;
  4. Order on the appointment of the person (persons) responsible for the storage of explosive materials;
  5. List of persons who will have access to explosives or guard them;
  6. Payment order (receipt) for the service. The administrative fee is 270 hryvnias.

III. For transportation on the territory of Ukraine (validity period up to 3 months)

  1. Permission of the police authority to store explosive materials;
  2. Information on persons responsible for transportation;
  3. Name, quantity of cargo to be transported, mode of transport, route, initial and final points of transportation through the territory of Ukraine, basis of transportation, term;
  4. Information on persons responsible for the protection of explosive materials;
  5. A copy of the security agreement or orders of the head of the enterprise on the appointment of persons responsible for security and transportation;
  6. Certificate on the training of an authorized person on the safety of cargo transportation. The administrative fee is 270 hryvnias);
  7. Certificate on the training of drivers of vehicles transporting dangerous goods (the administrative fee is UAH 270);
  8. Certificate on the admission of vehicles to transport specified dangerous goods (Administrative fee is UAH 93);
  9. Valid compulsory insurance contract;
  10. Certificate on the driver’s admission to transport explosive materials on the territory of Ukraine (Administrative fee is 78 hryvnias);
  11. Payment order (receipt) for the service. The administrative fee is 270 hryvnias.
  12. Technical conditions or standards of explosive materials to be transported through the territory of Ukraine.

As an exception, the transportation of explosive materials through the territory of Ukraine without the permission of the police is carried out in the case of:

  1. Centralized transportation from manufacturing plants to warehouses in the presence of permits for the storage of explosive materials;
  2. From one structure of the business entity to another, but only within one region (city) on the basis of invoices in accordance with Appendix 37 Instructions;
  3. To the places where demolition works are carried out - according to orders-tickets in accordance with Appendix 38 Instructions.

IV. For destruction

To destroy explosive materials, it is necessary to obtain certification for this type of activity. According to Resolution of the Cabinet of Ministers of Ukraine No. 123 dated 02.02.2024, certification is carried out by accredited conformity assessment bodies , which carry out the certification of operators and processes of mine action to determine their compliance with the requirements established by the legislation of Ukraine and regulatory documents in the field of mine action. To obtain certification for the destruction of munitions, it is necessary to submit to the Head of the Certification Authority of the Mine Action Center:
